City of Hamilton loses Supreme Court appeal, found partially liable for 2007 crash

The decision, released Thursday, means the city is on the hook for one-third of yet-to-be decided damages to the now grown children, including one who suffered serious brain injury.
“My clients who were children and (are) now adults are extremely satisfied the liability case has come to an end in their favour,” said lawyer Rob Hooper, who represented the Smith plaintiffs.
“They look forward to being paid fair compensation for the tragic injuries they have sustained.”
