If you’ve been hurt because of someone else’s actions, or inaction, the particular type of claim isn’t too important. What is important is that you’ve been hurt, physically, emotionally or economically, often all of the above. You wonder if you have a viable path to recover compensation from the person who caused that hurt. There are a few key elements in claims of all types against another person for personal injury. More legal lingo to follow, but with some explanation. Liability The first element is “liability”. Liability answers the question: is the individual (or business) who you believe hurt you legally responsible for their actions or inaction? If the answer to this question is yes, then that individual or business (the “Defendant”) will be responsible for compensating you for the hurt that they have caused. Mr. McHugh had consumed alcohol and was exceeding the 70 kilometre per hour speed limit by at least 15 kilometres per hour. The occupants in Ms. Safranyos’s vehicle were all seriously injured. Lawsuits were brought on behalf of the injured children and their family members against Ms. Safranyos, Mr. McHugh, and the City of Hamilton (“Hamilton”). The basis for the claims against Ms. Safranyos and Mr. McHugh related to their alleged negligent manner of driving that played a role in causing the collision. In a unanimous decision, the Court of Appeal found the trial judge was wrong in instructing the jury that acquitted Peter Khill in June 2018. Khill had argued he was acting in self-defence when he fatally shot John Styres in 2016. The case initially took on racism overtones because Styres was Indigenous, although there was no evidence that Khill was aware of that when he opened fire. Khill also faces an ongoing civil lawsuit in which Styres' relatives are seeking more than $2 million in damages. Their lawyer, Rob Hooper, said on Wednesday that Khill has refused to be examined until the criminal case is resolved but this result is what they had hoped for. “We will continue to fight this injustice and fight for fair trials for Indigenous people in Canada,” Hooper said. FerroCounsel for the individual borrowers: Mary Grosso Interest rate on litigation loans reduced due to failure by loan company to comply with Consumer Protection legislation. Lexfund is a litigation loan company. It loaned money to five people who had been injured in motor vehicle accidents and commenced lawsuits for damages. The money was needed to cover living and medical expenses while their lawsuits went forward. All five individual borrowers were represented by the same lawyer, Lou Ferro. The Court held that Lexfund, with full knowledge of the Consumer Protection Act, made an informed decision not to comply with the Act’s disclosure provisions by sending that disclosure directly to Mr. Ferro and not the borrower as mandated by the Act. He held that Lexfund “flagrantly and with a sense of entitlement” crafted documents in an effort to allow it to process its loans without full compliance with the Consumer Protection Act.
